Kaufer's bill granting crime victims more rights signed into law

State Rep. Aaron Kaufer | Pennsylvania 120th Legislative District

Rep. Aaron Kaufer of Luzerne County announced the signing of his legislation aimed at addressing the rights of crime victims by Governor Tom Wolf. The new law, Act 134 of 2022, intends to rectify perceived imbalances between offenders and their victims regarding access to criminal history investigative information.

Kaufer stated, “While offenders have access to relevant criminal history investigative information due to their status in the criminal case, the crime victim had no legal right to access that very same information about the crime.” He emphasized the importance of balancing justice for crime victims, especially given rising crime rates.

The legislation facilitates a process for crime victims to request and obtain relevant information gathered by law enforcement during investigations. This information can be used in civil legal actions aimed at recovering damages for injuries sustained. Victims must declare under penalty of law that the requested information is essential for their civil case. The law strictly limits use of this information to civil lawsuits and prohibits its use for harassment or intimidation.

The act will become effective in 180 days.
